Are you a non-resident planning on selling property in France?
The general tax code provides an exemption for capital gains made on the sale of a property in France by private individuals, either from an EU country, or another country in the European Economic Area with a mutual agreement with France to combat fraud.
This exemption is 150,000 € of net capital gains, if you respect these 2 cumulative conditions:
- You have been a French tax resident for at least 2 years before the sale.
- The sale must take place no later than 31st December of the 5th year after you changed tax domicile (to outside of France).
However, there is no time limit if the property has not been rented out since 1st January of the year precedent to the year of sale.
For example, if you were a French tax resident but you changed your tax domicile in 2017, in this case you can benefit from this exemption until the end of December 2022.
